| DECISION & ORDER ON MOTION |
Motion by the defendant, in effect, for leave to reargue his prior motion pursuant to CPL 460.30 for an extension of time to take an appeal from a judgment of the Supreme Court, Queens County, rendered November 13, 2008, which was determined by decision and order on motion dated August 13, 2009.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted, upon reargument, the prior motion pursuant to CPL 460.30 for an extension of time to take an appeal from the judgment rendered November 13, 2008, is granted, the defendant's moving papers are deemed to constitute a timely notice of appeal, and the decision and order on motion dated August 13, 2009, is recalled and vacated.
