Upon the papers filed in support of the application and the motion, and no papers having been filed in opposition thereto, it

ORDERED that the application for an order pursuant to CPLR 5704 is granted, without costs, and matter remitted to Supreme Court,
Broome County, for the issuance of an order to show cause authorizing commencement of a proceeding by such service as Supreme Court deems
appropriate. It is further
ORDERED that the motion for permission to proceed as a poor person is granted, without costs, to the extent
that the filing fee required by CPLR 8022 for this application is waived.
