| DECISION & ORDER ON MOTION |
Renewed motion by the appellant pro se for leave to prosecute an appeal from an order of the Family Court, Queens County, dated September 29, 2009, as a poor person, and for the assignment of counsel.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied, with leave to renew on or before April 13, 2010, upon proper papers, including (1) documents indicating the value of the house owned by the appellant and the balance owed on the mortgage or mortgages encumbering the house, and (2) the appellant's affidavit setting forth the disposition of the proceeds of the sale of certain real property in June 2008.
