DECISION

The branches of the motion by defendant seeking leave to consolidate the appeal from the order, which denied his motion pursuant to CPL 440.20 to set aside his sentence and for resentencing, with the pending appeal from the judgment of conviction and to enlarge his time to file an appellant's brief are denied as moot.

We note that the branch of the motion by defendant for a certificate granting leave to appeal from the order denying his motion pursuant to CPL 440.20 to set aside his sentence and for resentencing, which was referred to Justice Iannacci for determination, has been denied.
