DECISION & ORDER ON MOTION

Motion by the plaintiff for leave to appeal to this court from an order of the Supreme Court, Nassau County, dated March 3, 2010, and to stay enforcement of a temporary restraining order contained in the order dated March 3, 2010, to the extent that it directs the plaintiff to post an undertaking in the sum of $300,000, and instead direct the plaintiff to deposit the sum of $8,000 monthly into escrow or to reduce the undertaking, pending hearing and determination of the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,

ORDERED that the motion is otherwise denied as academic.
