| DECISION & ORDER ON MOTION |
Motion by the respondent, joined by the appellants, for a preference in the calendaring of an appeal from an order of the Supreme Court, Queens County, entered August 7, 2009, and to preclude the filing of any additional or supplemental briefs.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the branch of the motion which is for a preference in the calendaring of the appeal is denied; and it is further,
ORDERED that the branch of the motion which is to preclude the filing of any additional or supplemental briefs is denied as unnecessary as all briefs have been filed (see 22 NYCRR 670.8, 670.9) and a party seeking to file additional or supplemental briefs must make a motion for that relief.
