Motion by the respondent to dismiss an appeal from an order of the Family Court, Westchester County, dated February 6, 2009, on the ground that the appellant did not settle the transcript.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied on condition that on or before May 6, 2010, the appellant settle the transcript (see CPLR 5525[c]), and file an errata sheet with this court.
