Motion by the appellant on an appeal from an order of the Supreme Court, Queens County, entered September 25, 2009, pursuant to CPLR 5520(a) to extend the time to file a notice of appeal, which was timely served.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that the time to file the notice of appeal, which was timely served, is extended until April 7, 2010; and it is further,
ORDERED that appellant shall file with this court proof of filing of the notice of appeal on or before April 7, 2010.
