DECISION & ORDER ON MOTION

Motion by the respondent for an order granting reconsideration of the measure of discipline imposed by this court and, upon reconsideration, reducing the period of suspension to no more than one year. By opinion and order of this court dated August 25, 2009, the respondent was suspended for a period of three years, commencing September 25, 2009, based on six charges of professional misconduct including knowingly making materially false statements to courts, engaging in conduct involving dishonesty, fraud, deceit or misrepresentation, engaging in frivolous conduct by filing a deficient record on appeal in the Appellate Division, First Department, and engaging in conduct prejudicial to the administration of justice and adversely reflecting on his fitness as an attorney (see Matter of Klarer, 66 AD3d 247). The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on January 30, 1985.

Upon the papers submitted in support of the motion and the papers submitted in opposition thereto, it is

ORDERED that the motion is denied.
