| DECISION & ORDER ON MOTION |
Motion by Nicholas Camarano to vacate any automatic stay which is in effect as a result of an appeal from an order of the Supreme Court, Nassau County, dated January 29, 2010, and to direct the Incorporated Village of Valley Stream to reinstate him on the payroll with full benefits. Cross motion by the Incorporated Village of Valley Stream for leave to appeal to this court from the order dated January 29, 2010, or pursuant to CPLR 5704 to vacate the preliminary injunction contained in the order dated January 29, 2010.
Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is
ORDERED that the cross motion is denied; and it is further,
ORDERED that on the court's own motion, the appeal purportedly taken as of right is dismissed, without costs or disbursements; and it is further,
ORDERED that the motion is denied as academic.
