| DECISION & ORDER ON MOTION |
Motion by the appellant for leave to file a supplemental record on an appeal from an order of the Supreme Court, Richmond County, dated May 11, 2009, and to enlarge its time to serve and file a reply brief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to file a supplemental record is granted, and on or before April 6, 2010, the appellant shall serve and file a supplemental record containing the guaranty and suretyship agreements annexed to their motion papers as Exhibits B and C; and it is further,
ORDERED that the branch of the motion which is to enlarge the time to serve and file a reply brief is denied as unnecessary, as the appellant's reply brief was served and filed on March 15, 2010.
