| DECISION & ORDER ON MOTION |
On the court's own motion, it is
ORDERED that its decision and order on motion dated March 22, 2010, in the above-entitled matter, which granted the defendant's motion for leave to prosecute appeals from two judgments of the Supreme Court, Suffolk County, both rendered October 6, 2009, as a poor person, and to proceed pro se, is amended by deleting from the introductory paragraph thereof the words "rendered October 6, 2010", and substituting therefor the words "rendered October 6, 2009", and by deleting from the eighth decretal paragraph thereof the words "ORDERED that on or before December 31, 2009, the appellant shall file a properly executed waiver of his right to appellate counsel, which waiver shall read as follows:", and substituting therefor the words "ORDERED that the branch of the motion which is for leave to proceed pro se is granted on condition that upon the filing of his appellate brief with this court, the appellant shall also file a properly executed waiver of his right to appellate counsel, which waiver shall read as follows:".
