| DECISION & ORDER ON MOTION |
Motion by the appellant on an appeal from an order of the Supreme Court, Rockland County, dated September 17, 2009, in effect, to amend so much of a decision and order on motion of this court dated January 12, 2010, as conditioned a stay of enforcement of the order dated September 17, 2009, upon the perfection of the appeal on or before February 16, 2010.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that the decision and order on motion dated January 12, 2010, is amended by deleting from the decretal paragraphs thereof the date "February 16, 2010," and substituting therefor the date "April 26, 2010"; and it is further,
ORDERED that the appellant's time to perfect the appeal is enlarged until April 26, 2010, and the record or appendix on the appeal and the appellant's brief must be served and filed on or before that date.
