DECISION & ORDER ON MOTION

Appeal by Pamela D. from an order of the Family Court, Kings County, dated December 1, 2009. By order to show cause dated February 5, 2010, the parties or their attorneys were directed to show cause before this court why an order should or should not be made and entered dismissing the appeal in the above-entitled proceeding on the ground that the appeal had been rendered academic.

Now, on the court's own motion, and the papers filed in response to the order to show cause, it is

ORDERED that the motion is denied; and it is further,

ORDERED that so much of the decision and order on motion of this court dated December 21, 2009, as directed the appellant to perfect the appeal by a date certain and set a briefing schedule is recalled and vacated, and the case is removed from the active management program.
