On the court's own motion, it is

ORDERED that so much of its decision and order on motion dated February 19, 2010, entitled "In the Matter of Dismissal of Causes for Failure to Perfect - January 2010 Calendar", as dismissed a proceeding pursuant to CPLR article 78, which was transferred to this court by order of the Supreme Court, Westchester County, dated June 23, 2009, is recalled and vacated; and it is further,

ORDERED that the proceeding is dismissed, without costs or disbursements, as this proceeding is a duplicate of a proceeding pending under Appellate Division Docket No. 2009-06452.
