It is Ordered that the motion to vacate this Court's December 3, 2009 order that dismissed the appeal is granted. The appeal is reinstated and the record, briefs and notice of argument are to be filed prior to July 1, 2010 and the appeal noticed for the September 2010 term. No further extension of time to perfect the appeal from a May 18, 2009 order of the New York Civil Court will be granted. The appellant is referred to 22 NYCRR § 640.6, regarding the time period to perfect an appeal to this Court.
