It is Ordered that the motion is granted to the extent of permitting the two appeals to proceed on the original record of the trial court. Any exhibits in the plaintiff's possession are to be filed with the Clerk of the Court by May 4, 2010. The cross-motion to dismiss is granted unless the appeal is perfected by April 13, 2010 and noticed for the June 2010 term. In the event of appellant's failure to comply with the foregoing condition, the respondent may move on five days' notice for an order dismissing the appeal.
