DECISION

On the court's own motion, motion by appellants returnable January 11, 2010, and motion by respondent returnable January 27, 2010, are consolidated for purposes of disposition.

Motion by respondent to file a late cross motion is granted and deemed timely served and filed.

The branch of the motion by appellants, in essence, for leave to reargue their prior motion to stay the order of the Civil Court dated June 18, 2008 is denied.

The branch of the motion to reconstruct the record is denied without prejudice to appellants moving for said relief in the Civil Court.

Cross motion by respondent for the imposition of sanctions and related relief is denied.
