Appeals having been taken herein from an order of the Family Court, Oneida County, entered in the Office of the Clerk of said Court on January 20, 2009, and respondent-appellant having made an application for an order vacating the order of this Court entered January 25, 2010, to the extent that it granted petitioner-respondent permission to proceed as a poor person and the assignment of counsel,
Now, upon reading and filing the affidavit of Christine Michaud, sworn to January 25, 2010, the affidavit of Scott Godkin, Esq., sworn to February 15, 2010, and due deliberation having been had thereon,
It is hereby ORDERED that the application is granted and the order of this Court entered January 25, 2010, insofar as it granted petitioner-respondent permission to proceed as a poor person and the assignment of counsel, is vacated, and
It is further ORDERED that petitioner-respondent file his briefs, together with proof of service, on or before March 22, 2010.
