Appeals having been taken herein from an order of the Family Court, Onondaga County, entered in the Office of the Clerk of said Court on March 20, 2009, and petitioner-respondent having moved to strike stated portions of the law guardian's brief on the ground that they refer to matters dehors the record,

Now, upon reading and filing the affirmation of J. Scott Porter, Esq., dated January 13, 2010, the notice of motion with proof of service thereof, the affirmation of Theodore W. Stenuf, Esq., dated January 19, 2010, and due deliberation having been had thereon,
