Respondent-appellant Shauna C. Tucker having moved to vacate the dismissal of the appeal taken herein from an order of the Family Court, Onondaga County, entered in the Office of the Clerk of said Court on March 20, 2009, for permission to submit a supplemental record on appeal, and for other relief,
Now, upon reading and filing the affirmation of Jon W. Brenizer, Esq., dated February 1, 2010, the notice of motion with proof of service thereof, the affirmation of J. Scott Porter, Esq., dated February 5, 2010, the statement of Theodore W. Stenuf, Esq., dated February 5, 2010, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks to vacate the dismissal of the appeal is granted and respondent-appellant shall file ten copies of her brief, addressing that portion of the order of Family Court by which she is aggrieved, together with proof of service, on or before March 9, 2010, and
It is further ORDERED that petitioner-respondent file ten copies of his responsive brief, together with proof of service, on or before April 13, 2010, and
It is further ORDERED that the motion insofar as it seeks permission to file a supplemental record on appeal is granted and respondent-appellant shall file the original and ten copies of the supplemental record, consisting of her notice of appeal and proof of service thereof, together with proof of service of the supplemental record, on or before March 9, 2010, and
It is further ORDERED that respondent-appellant's appeal shall be consolidated with the law guardian's appeal, and
It is further ORDERED that the respondent's brief previously filed on behalf of Shauna C. Tucker is stricken.
