Application by the appellant on an appeal from an order of the Supreme Court, Suffolk County, dated January 12, 2010, in effect, to amend so much of a decision and order on motion of this court dated March 10, 2010, as conditioned a stay upon the perfection of the appeal on or before April 9, 2010.
Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is granted; and it is further,
ORDERED that the decision and order on motion dated March 10, 2010, is amended by deleting from the first decretal paragraph thereof the date "April 9, 2010" and substituting therefor the date "July 8, 2010".
