DECISION & ORDER ON MOTION
Motion to Dismiss Appeal

Motion by the respondent to dismiss an appeal from an order of the County Court, Westchester County, entered February 2, 2010, on the ground that no appeal is authorized by right or by permission pursuant to CPL article 450.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted and the appeal is dismissed, as no appeal lies either by right or permission (see CPL 450.10, 450.15).
