It is Ordered that the motion to dismiss is granted unless the appeal is perfected by no later than the September 2010 term - the filing deadline is July 1, 2010. In the event of the plaintiff-appellant's failure to comply with the foregoing condition, the defendants-respondents may move on five days notice form an order dismissing the appeal.
