| DECISION & ORDER ON MOTION |
Motion by the appellant Pushpa Rani to stay enforcement of a judgment of the Supreme Court, Nassau County, entered September 25, 2009, as well as all foreclosure proceedings, pending hearing and determination of an appeal from the judgment, and, in effect, to consolidate the appeal from the judgment with an appeal from an order of the same court entered October 7, 2008, which was determined by decision and order of this court dated March 23, 2010.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for a stay is denied in light of the determination of the appeal from the order entered October 7, 2008 (see Wells Fargo Bank v Das Karla, ___ AD3d ___ [2d Dept., March 23, 2010]; and it is further,
ORDERED that the branch of the motion which is to consolidate the appeals is denied as academic.
