Respondent-appellant having moved for permission to proceed as a poor person and for assignment of counsel on the appeals taken herein from an order of the Family Court, Monroe County, entered in the Office of the Clerk of said Court on November 30, 2009 (CAF 10-00132), and a corrected decision of the Family Court, Monroe County, dated December 1, 2009 (CAF 10-00773),
Now, upon reading and filing the affidavit of Joshua Bundy, sworn to March 16, 2010, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is denied, and
It is further ORDERED that the appeal from the corrected decision dated December 1, 2009, is dismissed on the ground that no appeal lies from a decision (see Kuhn v Kuhn, 129 AD2d 967).
