| DECISION & ORDER ON MOTION |
Motion by the appellant, in effect, to recall and vacate a decision and order on motion of this court dated October 6, 2009, which dismissed an appeal from an order of the Family Court, Westchester County, dated February 27, 2009, to reinstate the appeal, and to enlarge the record to include certain documents.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branches of the motion which are, in effect, to recall and vacate the decision and order on motion dated October 6, 2009, and to reinstate the appeal are denied; and it is further,
ORDERED that the branch of the motion which is to enlarge the record to include certain documents is denied as academic.
