Upon the papers filed in support of the motion and the cross motion and the papers filed in opposition thereto, it
is
ORDERED that the motion for a stay pending the appeal is denied, without costs, and it is further
ORDERED that
the cross motion to dismiss defendant's appeal is denied, without costs. The appeals shall be heard together and defendant's time to perfect his
appeal from the December 7, 2009 order of the Supreme Court is extended to May 17, 2010. Plaintiff's time to perfect her appeal from the May
20, 2009 order of said court is extended to 45 days from filing and service of defendant's record on appeal and brief.
