It is Ordered that the motion for a stay of the enforcement of the judgment is granted, pending the determination of the appeal, on condition that the stipulated funds remain in escrow and the appeal is perfected by the September 2010 term. In the event of appellant's failure to perfect the appeal by July 1, 2010, the respondents may move on five days' notice for an order vacating the stay.
