Motion by the appellant for leave to reargue an appeal from an order of the Surrogate's Court, Queens County, dated October 29, 2008, which was determined by decision and order of this court dated February 9, 2010. Cross motion by the respondent to direct the appellant to obtain prior approval from the court before making further motions.
Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is
