Appellant having moved to proceed pro se on the appeal taken from the judgment of the Onondaga County Court, rendered January 29, 2009 and for other relief,
Now, upon reading and filing the affidavit of Corey M. Slattery sworn to February 10, 2010 and the statement of Corey M. Slattery dated March 3, 2010, the notice of motion with proof of service thereof, the affirmation of Philip Rothchild, Esq., dated February 26, 2010 and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that the order of this Court entered July 15, 2009 is vacated, and appellant may prosecute his appeal as a poor person pro se, and
It is further ORDERED that the appeal herein may be prosecuted upon the original papers and ten briefs, handwritten, typewritten or reproduced pursuant to CPLR 5529, and
It is further ORDERED that the Clerk of the County of Onondaga is hereby directed to provide Corey Slattery with copies of all papers and transcripts of stenographic or audio taped minutes, if any, of the proceedings upon which the appeal is based and,
It is further ORDERED that appellant shall file such papers and transcripts in the Office of the Clerk of this Court at the time he files his brief, together with proof of service of one copy of the brief on the District Attorney and this appeal will not be placed on the court calendar until such time as the transcripts and briefs are so filed.
It is further ORDERED that the motion is otherwise denied.
