On the court's own motion, it is
ORDERED that its decision and order on motion dated April 7, 2010, in the above-entitled matter, which determined a motion by Tom T. Yang , inter alia, for leave to appeal to this court from an order of the Family Court, Dutchess County, dated March 19, 2010, is amended by adding as the second decretal paragraph the following:
"ORDERED that on the court's own motion, the appeal purportedly taken as of right is dismissed, without costs or disbursements; and it is further,".
