| DECISION & ORDER ON MOTION |
Motion by the respondent to hold in abeyance an appeal from a resentence of the Supreme Court, Queens County, imposed September 15, 2008, pending determination by the United States Supreme Court of a writ of certiorari to be filed in an action entitled People v Williams NY3d [Feb 23, 2010]).
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that the respondent's time to serve and file a brief is enlarged until May 19, 2010, and the respondent's brief must be served and filed on or before that date.
