Motion by the respondent-appellant to strike stated portions of the joint record, the supplemental joint record, and the appellant-respondent's brief on appeals and cross appeals from two orders of the Supreme Court, Queens County, both dated February 3, 2009.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that the respondent-appellant's time to serve and file his answering brief, including the points of argument on the cross appeal (see 22 NYCRR 670.8[c][3]) is enlarged, and the respondent-appellant shall serve and file his answering brief on or before May 24, 2010.
