Stay of execution of judgment of resentence granted on condition appeal perfected within 120 days of date of this order;
appellant released on own recognizance upon same condition. If appellant fails to so comply with said condition within time specified, appellant shall surrender himself to Supreme Court, Bronx County, in order that execution of said judgment be resumed.
