Hudson St. Owners v Escoffier, Dana
It is Ordered that the motion for a stay of the enforcement of the March 19, 2010 monetary judgment is denied. [ see CPLR § 5519(a)(2) ]. The landlord-respondent's cross motion to dismiss the appeal from the December 15, 2009 Civil Court order is granted. The time to serve and file a notice of appeal from said order, after being served with a copy of that order with notice of its entry, has long expired. Accordingly, pursuant to CPLR § 5513(a), no appeal can be pursued from the December 15, 2001 order .
