Petitioners having moved for an extension of time to file and serve their brief in this proceeding initiated in this Court pursuant to Eminent Domain Procedure Law § 207 and to remove this appeal from the calendar for the September 2010 term of this Court and reschedule it for a later term, if necessary, consistent with any new deadline for filing petitioners' brief,
Now, upon reading and filing the affirmation of Emanuela D'Ambrogio, Esq. dated April 15, 2010, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks an extension of time for petitioners to file their brief is granted and petitioners shall file and serve their brief on or before May 26, 2010, and the Clerk is directed to accept the brief for filing, and
It is further ORDERED that respondents briefs shall be filed and served on or before June 25, 2010, and
It is further ORDERED that the motion insofar as it seeks to remove the appeal from the calendar for the September 2010 term is denied.
