Petitioner having moved for an extension of time to file and serve a brief on the CPLR article 78 proceeding transferred to this Court by order of the Supreme Court entered in the Office of the Clerk of the County of Monroe on December 10, 2009,
Now, upon reading and filing the affidavit of Mae T. Jones sworn to April 20, 2010, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that the ordering paragraph of the order of this Court entered March 2, 2010 is hereby amended by deleting the date April 30, 2010 and inserting in its place the date June 1, 2010, and
It is further ORDERED that the order of this Court entered March 2, 2010 is hereby amended such that respondents' briefs shall now be filed and served on or before July 6, 2010.
