DECISION & ORDER ON MOTION

Motion by the appellants-respondents on an appeal and cross appeal from an order of the Supreme Court, Kings County, dated August 13, 2009, in effect, to amend so much of a decision and order on motion of this court dated March 23, 2010, as conditioned a stay of the trial in the above-entitled action, upon the perfection of the appeal on or before April 22, 2010, and to enlarge the time to perfect the appeal.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that the decision and order on motion dated March 23, 2010, is amended by deleting from the decretal paragraphs thereof the date "April 22, 2010," and substituting therefor the date "June 22, 2010"; and it is further,

ORDERED that the time to perfect the appeal is enlarged until June 22, 2010, and the joint record or appendix on the appeal and the appellants-respondents' brief must be served and filed on or before that date.
