Motion by the appellant, inter alia, for leave to reargue his prior motion, pursuant to CPL 460.20, for a certificate granting leave to appeal to the Court of Appeals from a decision and order of this court dated July 28, 2009, which reversed a judgment of the County Court, Nassau County, rendered May 28, 2003.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is,
