Motion by the respondent on an appeal, by permission, from an order of the Family Court, Queens County, dated August 14, 2009, to vacate a stay of the order dated August 14, 2009, which was granted by decision and order on motion of this court dated September 3, 2009.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied as academic in light of our determination of the appeal (see Matter of Schick v Schick, ___ AD3d ___ [2d Dept, April 27, 2010]).
