| DECISION & ORDER ON MOTION |
Motion by the respondent for reconsideration/reargument of his prior motion to confirm the report of the Special Referee to dismiss the reciprocal disciplinary proceeding, which was determined by opinion and order dated September 29, 2009, and, upon reargument, to grant the motion to confirm and to dismiss the reciprocal disciplinary proceeding or to impose a sanction less severe than disbarment, or, in the alternative, for leave to appeal to the Court of Appeals from the opinion and order dated September 29, 2009. The respondent was disbarred as a result of a reciprocal disciplinary proceeding predicated upon his resignation from the Bar of the State of Connecticut. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on January 17, 1990.
Upon the papers submitted in support of the motion and the papers submitted in opposition thereto, it is
ORDERED that the motion is denied.
