| DECISION & ORDER ON MOTION |
Motion by the appellant for leave to prosecute an appeal from a judgment of the Criminal Court, Kings County, dated November 10, 2009, as a poor person and for the assignment of counsel.
Upon the papers filed in support of the motion, and no papers having been filed in opposition thereto, it is
ORDERED that on the court's own motion, the appeal and the motion are transferred to the Appellate Term of the Supreme Court, Second, Eleventh, and Thirteenth Judicial Districts, for determination, as the appeal is from a judgment of the Criminal Court, Kings County (see CPL 450.60[4]); and it is further,
ORDERED that all further proceedings in connection with this appeal and the motion shall be conducted pursuant to the rules of the Appellate Term, Second, Eleventh, and Thirteenth Judicial Districts.
