DECISION & ORDER ON MOTION

Motion by nonparty-appellant Gutman, Mintz, Baker & Sonnenfeldt, P.C. for a stay pending the determination of the appeal on an appeal from an order of the Civil Court of the City of New York, Kings County, entered December 14, 2009.
Upon the papers filed in support of said motion and no papers having been filed in opposition thereto, it is,
ORDERED that the motion by nonparty-appellant Gutman, Mintz, Baker & Sonnenfeldt, P.C. to stay the order of the Civil Court entered December 14, 2009 pending the determination of the appeal is granted on condition that the appeal be perfected on or before July 2, 2010; and it is further,
ORDERED that in the event that the above condition is not met, the court, on its own motion, may vacate the stay, or the respondent may move to vacate the stay on three days' notice.
