DECISION & ORDER ON MOTION

Motion by Tekiyah M. Yisrael, inter alia, to enlarge the time to perfect an appeal from an order of the Supreme Court, Kings County, dated July 29, 2009 (Appellate Division Docket No. 2009-08527), to consolidate that appeal with an appeal from a judgment of the Supreme Court, Kings County, rendered December 22, 2006 (Appellate Division Docket No. 2007-00452), for poor person relief with respect to the appeal from the order dated July 29, 2009, and for leave to file an oversized brief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to enlarge the time to perfect the appeal from the order dated July 29, 2009 (Appellate Division Docket No. 2009-08527), is granted, Tekiyah M. Yisrael's time to perfect that appeal is enlarged until June 18, 2010, and the record or appendix on that appeal and Tekiyah M. Yisrael's brief must be served and filed on or before that date; and it is further,

ORDERED that no further enlargement of time shall be granted; and it is further,

ORDERED that the branch of the motion which is to consolidate the appeals is denied; and it is further,

ORDERED that the motion is dismissed to the extent that it requests any other relief with respect to the appeal from the judgment rendered December 22, 2006 (Appellate Division Docket No. 2007-00452), on the ground that Tekiyah M. Yisrael is neither a party nor an attorney for a party to that action (see CPLR 321[a]); and it is further,

ORDERED that the branch of the motion which is to waive the motion filing fee is granted; and it is further,

ORDERED that the motion is otherwise denied.
