On the court's own motion, it is
ORDERED that its decision and order on motion dated April 16, 2010, in the above-entitled matter, which granted a motion by the appellant to vacate a decision and order on motion of this court dated August 26, 2009, on an appeal from an order and judgment (one paper) of the Supreme Court, Nassau County, entered January 16, 2009, is amended by (1) deleting from the preamble thereof the words "an order of the Supreme Court, Nassau County", and substituting therefor the words "an order and judgment (one paper) of the Supreme Court, Nassau County", and (2) adding to the third decretal paragraph after the word "record", the words "or appendix".
