DECISION & ORDER ON MOTION

Motion by the appellant pro se for leave to prosecute an appeal from a judgment of the Supreme Court, Suffolk County, rendered July 21, 2009, as a poor person, and for the assignment of counsel.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is denied, with leave to renew upon proper papers, including (1) documentation setting forth the value of the real property owned by the appellant and the amount of the outstanding mortgage debt and liens encumbering that real property and (2) the appellant's affidavit setting forth the amount and source of fees paid to retained counsel.
