DECISION & ORDER ON MOTION

Motion by appellant for leave to reargue or, in the alternative, to appeal to the Appellate Division, and cross motion by respondents to require appellant to seek leave of court as a condition precedent to the filing of a motion, on an appeal from a judgment of the Civil Court of the City of New York, Queens County, entered June 9, 2008.
Upon the papers filed in support of said motion and the papers filed in opposition thereto, and the papers filed in support of said cross motion and no papers having been filed in opposition thereto, it is,
ORDERED that the motion by appellant for leave to reargue or, in the alternative, to appeal to the Appellate Division is denied; and it is further,
ORDERED that the cross motion by respondents to require appellant to seek leave of court as a condition precedent to the filing of a motion is denied.
