Motion by the defendant for leave to appeal to this court from an order of the Appellate Term, Ninth and Tenth Judicial Districts, dated December 9, 2009, which reversed insofar as appealed from an order of the Third District Court, Nassau County, entered May 21, 2008, and dismissed an appeal from an order of the same court entered November 26, 2008.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied.
