Motion by appellant for a stay pending the determination of the appeal on an appeal from an order of the Civil Court of the City of New York, Queens County, entered July 21, 2009.

Upon the papers filed in support of the motion and no papers have been filed in opposition thereto, it is,

ORDERED that the motion by appellant for a stay pending the determination of the appeal is granted on condition that the appeal be perfected on or before August 6, 2010; and it is further,

ORDERED that in the event the above condition is not met, the court, on its own motion, may vacate the stay, or the respondent may move to vacate the stay on three days' notice.
